Payroll Across Borders: What India-Based Businesses Need to Know About ANZ Employment Law

As more Indian businesses expand into Australia and New Zealand, payroll and employment compliance has become an increasingly live issue. The penalties for getting it wrong are significant — and ignorance of local law is not a defence.

Australia: the key obligations

Australian employment law is governed federally by the Fair Work Act. All employees must be paid at least the National Minimum Wage and applicable award rate for their industry. Employers must make Superannuation Guarantee contributions — currently 11.5% of ordinary time earnings — into a compliant super fund. Workers must receive payslips for every pay period. Casual, part-time and full-time employees all have specific entitlements that must be correctly applied.

New Zealand: the key differences

New Zealand has its own employment framework under the Employment Relations Act. The minimum wage is reviewed annually. KiwiSaver — New Zealand's retirement savings scheme — requires employer contributions of at least 3% for enrolled employees. Annual leave entitlements (four weeks per year) and public holiday provisions are non-negotiable. New Zealand has a "good faith" obligation that runs through employment relationships and dispute resolution.

The permanent establishment risk

One issue that catches Indian businesses off guard is the concept of permanent establishment for tax purposes. If your employees in Australia or New Zealand are carrying out the core business activities of your company, you may inadvertently create a taxable presence in that country. Taking advice on this early is significantly less expensive than dealing with the consequences later.

Using a Professional Employer Organisation (PEO)

For businesses that want to employ people in Australia or New Zealand without establishing a local legal entity, a PEO provides a practical solution. The PEO becomes the employer of record, managing compliance, payroll, and statutory obligations, while the actual work is directed by the client business. This is increasingly the preferred entry model for Indian companies with small ANZ teams.
