These Terms of Service ("Terms") govern your use of the Cubicle Compass website and our recruitment, staffing, and HR consulting services. By accessing our website or engaging our services, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our website or services.

1. About Cubicle Compass

Cubicle Compass is an independent recruitment and HR consulting practice providing services including recruitment and staffing, HR consulting, candidate assessments, and payroll support across India, Australia, and New Zealand.

2. Use of Our Website

You agree to use our website only for lawful purposes. You must not:

  • Submit false, misleading, or fraudulent information
  • Attempt to gain unauthorised access to any part of our website or systems
  • Use our website to transmit viruses, malware, or harmful code
  • Use automated systems (such as bots or scrapers) to extract data from our website without permission
  • Impersonate any person or entity, or misrepresent your affiliation

We reserve the right to restrict or terminate access to our website for any user who breaches these Terms.

3. Services for Candidates

When you submit your CV, apply for a role, or register your interest with Cubicle Compass:

  • You confirm that the information you provide is accurate, complete, and not misleading
  • You authorise us to share your information with prospective employers, subject to the confidentiality commitments in our Privacy Policy
  • You understand that registering with us does not guarantee that we will find you a role, or that any particular role will be offered to you
  • We may conduct reference checks, verify qualifications, or request additional information as part of the recruitment process
  • Any offer of employment is made directly between you and the hiring employer; Cubicle Compass acts as an intermediary and is not a party to that employment relationship

4. Services for Clients (Employers)

When you engage Cubicle Compass to provide recruitment, staffing, or HR consulting services:

  • Engagement terms, fees, and payment schedules will be set out in a separate proposal, service agreement, or engagement letter, which forms part of these Terms once signed or accepted
  • You agree to provide accurate information about the role(s) you are seeking to fill and to engage with the recruitment process in good faith
  • You agree not to bypass Cubicle Compass to engage directly with a candidate introduced by us, outside the terms of our fee agreement, within the applicable engagement period
  • Fees are payable in accordance with the terms set out in your specific proposal or agreement (typically based on a percentage of the placed candidate's salary, a fixed fee, or a retainer arrangement)
  • Any replacement guarantee offered is subject to the specific terms set out in your engagement agreement

5. Fees and Payment

Fee structures vary by engagement and are detailed in individual proposals or service agreements. Generally:

  • Recruitment fees are payable upon successful placement of a candidate, unless otherwise agreed
  • Invoices are payable within the timeframe specified on the invoice (typically Net 15–60 days)
  • Late payments may incur interest or additional administrative charges as permitted by applicable law
  • All fees are exclusive of applicable taxes (such as GST) unless stated otherwise

6. Intellectual Property

All content on our website — including text, graphics, logos, and design — is the property of CubicleCompass or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use our content for commercial purposes without our prior written consent.

7. No Guarantee of Outcomes

While we make every effort to match candidates with suitable roles and to source qualified candidates for our clients, we do not guarantee:

  • That any candidate will be offered or accept a role
  • That any client will find a suitable candidate within a particular timeframe
  • The ongoing performance, conduct, or suitability of any candidate placed in a role, beyond the specific guarantees set out in an individual service agreement

8. Limitation of Liability

To the maximum extent permitted by law, CubicleCompass shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services, including but not limited to loss of profits, loss of opportunity, or loss of data.

Our total liability to you for any claim arising from our services shall not exceed the total fees paid by you to CubicleCompass for the specific engagement giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including, where relevant, consumer protection law in India, Australia, or New Zealand).

9. Confidentiality

Both candidates and clients can expect that information shared with CubicleCompass during the recruitment process will be treated confidentially, in accordance with our Privacy Policy. We expect clients and candidates to likewise treat any commercially sensitive information shared during an engagement as confidential.

10. Termination

We reserve the right to suspend or terminate your access to our website or services at our discretion, including where we reasonably believe you have breached these Terms.

Either party may terminate a service engagement in accordance with the notice provisions set out in the relevant service agreement or proposal.

11. Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles, unless a specific service agreement with a client in Australia or New Zealand specifies otherwise. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the courts of India, unless otherwise agreed in writing.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be effective from the date posted on our website. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
